AG fighting murderer's release

Detroit — State Attorney General Bill Schuette is appealing a federal judge's decision to release a convicted murderer as he awaits a potential new trial.

Schuette's attorneys on Thursday failed to convince U.S. District Judge Arthur Tarnow that Dwayne Ballinger Jr. should stay locked up pending their appeal of an earlier decision that raised serious questions about Ballinger's double murder conviction.

Ballinger was accused of gunning down two men in a dispute over drug-dealing territory and was serving two life sentences.
